Suing After a Break-Up

Jilted bride wins $150,000.

RoseMary Shell said she moved to Hall County from Florida, leaving behind a high-paying job, to join Wayne Gibbs. She also said that she has suffered emotionally and financially since their break-up in 2007.

Gibbs said he paid off $30,000 of Shell’s debt during their engagement and also took her on trips. When he found out Shell had even more debt, he canceled the wedding. He notified her by leaving a note in their bathroom.

Hmmm…I don’t know about this one. I heard the story last night on the Atlanta news. Seems like a stretch, but what the heck do I know.

Can you really sue someone for dumping you? Well, obviously you can, so I guess I should ask if you should be able to sue someone for dumping you?

I dunno about suing someone for dumping you, but I remember my wife telling me when she was going through torts that there’s something called loss of consideration (I think) under which you can sue someone who commits adultery with your spouse. I was really thrown by that. Only some states allow those suits, though.

  2. Chris – its called a suit for “intentional alienation of affection.” Our of the three states I’m licensed to practice law in, only one of them recognizes the suit. As for whether or not you should be able to sue for being dumped; I think the jilted one should be able to sue to get personal property back and that type of thing, but not for emotional distress, because that would be opening a pandora’s box of litigation.

  3. this case was one where the couple was engaged. she wasn’t suing to get property back, she was suing because she quit a higher paying job for a lower one in order to move to be with her partner, who dumped her after realizing that – after he had paid off more than $30k of her debt – that she still had more.

    I am pretty sure that this will go to an appeal.

  4. The judge in this case should be disbarred. The fact that this ruling was made is complete proof that the US “justice” system does not work. It is less than worthless, it actually enforces tyranny.

    The people of the US should demand either that judges like this are held accountable, and demand a complete upheaval of the court system, which has been proven to be arbitrary and unjust. Better to have no government at all than to have tyrannical fascism imposed by an un-elected judge.
